Prebates going going gone.....
Static Control Components has had its motion accepted to reconsider a previous ruling regarding Lexmark's Prebate cartridges.
On Tuesday, United States District Judge Gregory F. Van Tatenhove accepted Static Control Components' motion and "Lexmark's Prebate terms are not enforceable under patent law in light of Quanta Computer, Inc. v LG Electronics, Inc." the Court found.
In 1997, Lexmark started a Prebate marketing program for its Optra S printer cartridges.
The Prebate program prohibited the cartridge user from sending the cartridge to a remanufacturer once its first useful life was complete.
The customer was instructed to either send the cartridge back to Lexmark or throw it away.
